The European Union is taking serious steps towards controlling Big Tech further and enforcing a competitive market within its territory.

They recently passed the Digital Markets Act and Digital Services Act laws which apply to companies that have a significant market presence in the EU. The former one is about assuring real competition by doing things like pry open app stores to competition, require a service to accept advertising for its competitors or assure end-users have access to the data they generate through their services. As well, the latter one regulates online services to assure a user experience with these services that is safe and in harmony with European values as well as supporting innovation and competitiveness.

Initially, six powerful Big Tech companies have been designated as “gatekeepers” under the Digital Markets Act. These are Alphabet (Google, Jigsaw, Nest), Amazon, Meta (Facebook, Facebook Messenger, Instagram, Threads, WhatsApp), Apple, ByteDance (TikTok) and Microsoft.

Most of the products like Facebook, Instagram, TikTok, YouTube, Amazon’s marketplaces, the familiar Google search engine, and the mobile app stores ran by Apple and Google are listed services or platforms subject to scrutiny as “gateways”. Even the iOS, Android and Microsoft Windows desktop operating systems are also deemed “gateways” under this law. But I am surprised that the Apple MacOS operating system wasn’t even deemed as a “gateway” under that law.

There is further investigation about Microsoft’s Bing search platform, Edge browser and Advertising platform and Apple’s iMessage messaging service regarding deeming them as “gateways”.

The latter one has attracted intense scrutiny from the computing press due to it not being fully interoperable with Android users who use first-party messaging clients compliant with the standards-based RCS advanced-messaging platform put forward by the GSM Association. This causes a significantly-reduced messaging experience if iPhone users want to message Android users, such as not being able to share higher-resolution images.

What happens is that “Gatekeeper” IT companies will be under strict compliance measures with requirement to report to the European Commission. These include requirements to:

  • accept competitors on their platform, which will apply to app stores, operating systems and online advertising platforms
  • ensure that end-users have access to data they generate on the platform
  • allow end-users and merchants to complete transactions away from app-store and similar platforms owned by the gatekeeper company
  • assure independent verification by advertisers of ad impressions that occur on their ad-tech platform

At the moment, an online service or similar IT company is considered a “gatekeeper” if they have:

  • EUR€7.5bn turnover
  • EUR€75 billion market capitalisation
  • 45 million or more active users in the 27 European-Union member countries

Personally, I would like to see the geographic realm for active users based on a larger area in Europe because of non-EU countries like Switzerland, Norway, Iceland and the UK and EU-candidate countries also contributing to the user base. For example, this could be based on the European Economic Area or membership of the Council of Europe which standardises fundamental human-rights expectations in Europe.

Failure to comply will see the company face fines of 10% of its global turnover, even the ability for the European Union bureaucrats to subject a company to a Standard Oil / AT&T style forced breakup.

At the moment, it is about EU setting an example on reining in Big Tech with DMA being considered a gold standard by the consumer IT press just as GDPR was considered a gold standard for user privacy. But the United Kingdom is putting a similar recommendation in place by introducing the Digital Markets, Competition and Consumer Bill before Parliament. This is while the USA are trying to pry open app stores with various anti-trust (competitive-trade) and similar legislation.

A question that will also arise is whether the European Union bureaucrats can effectively have control over corporations anywhere in the world such as to force the breakup of a dominant corporation that is chartered in the USA for example. This is although they could exert this power over a company’s local affiliate offices that exist within Europe for example.

There is still a very serious risk of Big Tech “dumping” non-compliant software and services in to jurisdictions that aren’t covered by these regulations. This will typically manifest in software or services that have the features desired by customers like sideloading or competitive app-store access for mobile operating systems or ad-free subscription versions of social networks being only available in Europe for example. This was a practice that happened with Microsoft when the EU forced them to allow the end-user to install an alternative Web browser when they install Windows as part of commissioning a new computer for example, with this feature only occurring within Europe.

A previous analogy I used is what has been happening with the vehicle market in Australia where vehicles that aren’t fuel-efficient to current international expectations appear in this country whereas other countries benefit from those vehicles that are fuel-efficient. This is due to Australia not implementing the fleet-wide fuel-efficiency standards being used in many countries around the world.

Who knows how long it will take to push similar legislation or regulation aimed at curbing Big Tech’s marketplace powers around the world. Only time will tell.

What can be done about taming political rhetoric on online services?

In this day and age, a key issue that is being raised regarding the management of elections and referenda is the existence of extreme political rhetoric on social media and other online services.

But the main cause of this problem is the algorithmic nature associated with most online services. This can affect what appears in a user’s default news feed when they start a Facebook, Twitter or Instagram session; whether a bulk-distributed email ends up in the user’s email inbox or spam folder; whether the advertising associated with a campaign appears in search-driven or display online advertising; or if the link appears on the first page of a search-engine user experience.

This is compared to what happens with traditional media or postal services while there is an election or referendum. In most of the democracies around the world, there are regulations overseen by the electoral-oversight, broadcasting and postal authorities regarding equal access to airtime, media space and the postal system by candidates or political parties in an election or organisations defending each option available in a referendum. If the medium or platform isn’t regulated by the government such as what happens with out-of-home advertising or print media, the peak bodies associated with that space establish equal lowest-cost access to these platforms through various policies.

Examples of this include an equal number of TV or radio commercial spots made available at the cheapest advertising rate for candidates or political parties contesting a poll, including the same level of access to prime-time advertising spaces; scheduled broadcast debates or policy statements on free-to-air TV with equal access for candidates; or the postal service guaranteeing priority throughput of election matter for each contestant at the same low cost.

These regulations or policies are to make it hard for a candidate, political party or similar organisation to “game” the system but allow voters to make an informed choice about whom or what they vote for. But the algorithmic approach associated with the online services doesn’t guarantee the candidates equal access to the voters’ eyeballs thus requiring the creation of incendiary content that can go viral and be shared amongst many people.

What needs to happen is that online services have to establish a set of policies regarding advertising and editorial content tendered by candidates, political parties and allied organisations in order to guarantee equal delivery of the content.  This means marking such content so as to gain equal rotation in an online-advertising platform; using “override markers” that provide guaranteed recorded delivery of election matter to one’s email inbox or masking interaction details associated with election matter posted on a Facebook news feed.

But the most important requirement is that the online platforms cannot censor or interfere with the editorial content of the message that is being delivered to the voters by them. It is being seen as important especially in a hyper-partisan USA where it is perceived by conservative thinkers that Silicon Valley is imposing Northern-Californian / Bay-Area values upon people who use or publish through their online services.

A question that can easily crop up is the delivery of election matter beyond the jurisdiction that is affected by the poll. Internet-based platforms can make this very feasible and it may be considered of importance for, say, a country’s expats who want to cast their vote in their homeland’s elections. But people who don’t live within or have ties to the affected jurisdiction may see it as material of little value if there is a requirement to provide electoral material beyond a jurisdiction’s borders. This could be answered through social-media and email users, or online publishers having configurable options to receive and show material from multiple jurisdictions rather than the end-user’s current jurisdiction.

What is being realised here is that online services will need to take a leaf out of traditional regulated media and communication’s playbook to guarantee election candidates’ fair equal access to the voters through these platforms.

Facebook is introducing a feature that allows its users to effectively “mute” political advertising including issues-driven advertising on their main social-Web platform as well as Instagram.

This feature will be available to USA-based accounts as part of Facebook’s voter-information features for the 2020 Presidential Elections. That includes information on how and where to register along with where and when to vote, including early-voting (pre-poll voting) and postal-voting information. It underscores Facebook’s role as part of Silicon Valley’s effort to “get out the vote” in the USA.

Personally I am not sure whether this setup will provide information relevant to American expats who have moved to other countries like how their local US embassy or consulate is facilitating their vote. It is because in most cases these expats will still have voting rights of some sort for US elections.

The option will be available in the “Ad Preferences” option for your platform’s user-account settings on both Facebook and Instagram. Or both platforms will have a contextual option, highlighted under a stylised “i”, available for political ads allowing you to see fewer ads of this type, This can be set up using your Web-based user experience or the official native mobile-platform apps that you use for working these platforms with.

Of course, there won’t be the ability to regulate editorial content from media organisations that is posted or shared through Facebook or Instagram. This will be an issue when you deal with media outlets that have a highly-partisan editorial policy. Nor will there be the ability to control posts, shares and comments from Pages and Profiles that aren’t shared as a paid advertisement.

There may also be questions about whether your favourite politician’s, political party’s or civic-society organiation’s Facebook or Instagram traffic will appear in your platform’s main view especially if they pay to increase viewership of these posts. It can be of concern for those of us who have a strong role in political and civic society and see the Facebook traffic as a “news-ticker” for the political entities we engage with.

Facebook has an intent to roll this feature out to other countries where they have established systems for managing and monitoring political advertising on their platforms. At least they are the first online ad platform that allows users to have control over the political and issue advertising that they see while they use that platform.

An issue that has been called out at the end of April this year is the improper use of endorsements by celebrities and brands by online snake-oil salesmen.

ABC’s Media Watch and TV Tonight talked of this situation appearing on Facebook and other online advertising platforms. Typically the people and entities being affected were household names associated with the “screen of respect” in the household i.e. the TV screen in the lounge room. It ranged from the free-to-air broadcasters themselves including the ABC who adheres strictly to the principles established by the BBC about endorsement of commercial goods and services, as well as TV shows like “The Project” or “Sunrise”, or TV’s key personalities like Eddie McGuire and Jessica Rowe.

Typically the ads containing the fake endorsements would appear as part of Facebook’s News Feed or in Google’s advertising networks, especially the search-driven Adwords network. I also see this as being of risk with other online ad networks that operate on a self-serve process and offer low-risk high-return advertising packages such as “cost-per-click-only” deals and had called this out in an earlier article about malvertisement activity.

There has been recent investigation activity by the Australian Competition and Consumer Commission concerning the behaviour of the Silicon Valley online-media giants and their impact on traditional media around the world. It will also include issues relating to Google and its control over online search and display advertising.

Facebook have been engaging in efforts to combat spam, inauthentic account behaviour and similar activity across its social-network brands. But they have found that it is a “whack-a-mole” effort where other similar sites or the same site pops up even if they shut it down successfully. I would suspect that a lot of these situations are based around pages or ads linking to a Website hosted somewhere on the Internet.

A question that was raised regarding this kind of behaviour is whether Facebook, Google and others should be making money out of these scam ads that come across their online platforms. This question would extend to the “estate agents” and “landlords” of cyberspace i.e. the domain-name brokers and the Webhosts who offer domain names or Webhosting space to people to use for their online presence.

There is also the idea of maintaining a respectable brand-safe family-and-workplace-friendly media experience in the online world which would be very difficult. This issue affects both the advertisers who want to work in a respectable brand-safe environment along with online publishers who don’t want their publications to convey a downmarket image especially if the invest time and money in creating quality content.

As we see more ad-funded online content appear, there will be the call by brands, publishers and users to gain control over the advertising ecosystem to keep scam advertising along with malvertisements at bay along with working against ad fraud. It will also include verifying the legitimacy of any endorsements that are associated with a brand or personality.

A good practice for advertisers and publishers in the online space would be to keep tabs on the online advertising beheaviour that is taking place. For example, an advertiser can keep reporting questionable impressions of their advertising campaigns including improper endorsement activity while a publisher can report ads for fly-by-night activity that appear in their advertising space to the ad networks they use. Or users could report questionable ads on the Social Web to the various social network platforms they see them appear on.

I regularly cover the issue of fake news and misinformation especially when this happens around election cycles. This is because it can be used as a way to effectively distort what makes up a democratically-elected government.

When the Victorian state government went to the polls last year, I ran an article about the issue of fake news and how we can defend ourselves against it during election time. This was because of Australia hosting a run of elections that are ripe for a concerted fake-news campaign – state elections for the two most-populous states in the country and a federal election.

It is being seen as of importance due to fact that the IT systems maintained by the Australian Parliament House and the main Australian political parties fell victim to a cyber attack close to February 2019 with this hack being attributed to a nation-state. This can lead to the discovered information being weaponised against the candidates or their political parties similar to the email attack against the Democrat party in the USA during early 2016 which skewed the US election towards Donald Trump and America towards a highly-divided nation.

The issue of fake news, misinformation and propaganda has been on our lips over the last few years due to us switching away from traditional news-media sources to social media and online search and news-aggregation sites. Similarly, the size of well-respected newsrooms is becoming smaller due to reduced circulation and ratings for newspapers and TV/radio stations driven by our use of online resources. This leads to poorer-quality news reporting that is a similar standard to entertainment-focused media like music radio.

A simplified low-cost no-questions-asked path has been facilitated by personal computing and the Internet to create and present material, some of which can be questionable. It is now augmented by the ability to create deepfake image and audio-visual content that uses still images, audio or video clips to represent a very convincing falsehood thanks to artificial-intelligence. Then this content can be easily promoted through popular social-media platforms or paid positioning in search engines.

Such content takes advantage of the border-free nature of the Internet to allow for an actor in one jurisdiction to target others in another jurisdiction without oversight of the various election-oversight or other authorities in either jurisdiction.

I mentioned what Silicon Valley’s online platforms are doing in relation to this problem such as restricting access to online advertising networks; interlinking with fact-check organisations to identify fake news; maintaining a strong feedback loop with end-users; and operating robust user-account-management and system-security policies, procedures and protocols. Extant newsrooms are even offering fact-check services to end-users, online services and election-oversight authorities to build up a defence against misinformation.

But the Australian Electoral Commission is taking action through a public-education campaign regarding fake news and misinformation during the Federal election. They outlined that their legal remit doesn’t cover the truthfulness of news content but it outlines whether the information comes from a reliable or recognised source, how current it is and whether it could be a scam. Of course there is the issue of cross-border jurisdictional issues especially where material comes in from overseas sources.

They outlined that their remit covers the “authorisation” or provenance of the electoral communications that appear through advertising platforms. As well, they underscore the role of other Australian government agencies like the Australian Competition and Consumer Commission who oversee advertising issues and the Australian Communications And Media Authority who oversee broadcast media. They also have provided links to the feedback and terms-and-conditions pages of the main online services in relationship to this issue.

These Federal agencies are also working on the issue of electoral integrity in the context of advertising and other communication to the voters by candidates, political parties or other entities; along with the “elephant in the room” that is foreign interference; and security of these polls including cyber-security.

But what I have outlined in the previous coverage is to look for information that qualifies the kind of story being published especially if you use a search engine or aggregated news view; to trust your “gut reaction” to the information being shared especially if it is out-of-touch with reality or is sensationalist or lurid; checking the facts against established media that you trust or other trusted resources; or even checking for facts “from the horse’s mouth” such as official press releases.

Inspecting the URL in your Web browser’s address bar before the first “/” to see if there is more that what is expected for a news source’s Web site can also pay dividends. But this can be a difficult task if you are using your smartphone or a similarly-difficult user interface.

I also even encourage making more use of established trusted news sources including their online presence as a primary news source during these critical times. Even the simple act of picking up and reading that newspaper or turning on the radio or telly can be a step towards authoritative news sources.

As well, I also encourage the use of the reporting functionality or feedback loop offered by social media platforms, search engines or other online services to draw attention to contravening content This was an action I took as a publisher regarding an ad that appeared on this site which had the kind of sensationalist headline that is associated with fake news.

The issue of online misinformation especially during general elections is still a valid concern. This is more so where the online space is not subject to the kinds of regulation associated with traditional media in one’s home country and it becomes easy for foreign operators to launch campaigns to target other countries. What needs to happen is a strong information-sharing protocol in order to place public and private stakeholders on alert about potential election manipulation.

The new direction for online audio content

Previously there were the radio shows which were a packaged item of audio content that was broadcast by one or more stations at one or more known times. These effectively drove radio along before television came to the fore but still exist mainly in an informative manner.

This can happen in the form of talk shows primarily run on stations that run informative content to music documentaries and Top-40 countdown shows run on the commercial music stations. In some cases, scripted radio drama still exists, especially with the BBC or some community radio stations who syndicate drama series. This is in conjunction with some radio stations doing book readings, mostly for vision-impaired people but also appealing to other users like drivers.

Often what would happen if other stations are interested in the same radio show is that they would “syndicate” the show by buying rights to broadcast the show themselves. In most cases, each episode of the show would be delivered as a recording that would be played at a scheduled time that is part of the agreement. A live show prepared by an originating station may simply be streamed out to local stations who are syndicating it thanks to satellite or similar communications technologies.

But this concept is still being pushed onwards in the form of the podcast which is today’s equivalent of these radio shows. Here, these shows are available for download and can be followed using a podcast manager that you run on your regular computer or mobile device. The podcast manager, typically part of a media management program, would check for and download the latest podcasts on to your equipment and, in some cases, synchronise them to MP3 players or similar devices.

Increasingly, streaming-audio-content services like Internet-radio or music-on-demand services are becoming podcast-delivery platforms themselves. Here, the content is streamed out via the service rather than being made available for download to your computer’s local storage, but the service may offer a download option for offline listening.

Infact the podcast is being valued by radio stations in a few different ways. For example, a radio station who runs a regular radio show will offer past and current episodes of this show for download as a podcast. This can come in handy for people new to a show, who have missed episodes of that show or like to hear it at their own time and pace.

Similarly, radio stations may syndicate a podcast that their network or someone else has created. This may be used to fill a programming void that may exist while one or more of the regular shows is on hiatus.

An issue that is affecting podcasts today is how they can work with an advertising context especially if people are moving away from advertising-driven radio. Typically the podcaster who wanted to sell advertising time would have to run the same approach as a syndicated radio show that is sponsored by one or more companies.  Here, the sponsored show will have “baked in” advertising offered by the show’s sponsors that is recorded as part of the show, which is different from the “spot” approach with ads that are inserted by the broadcaster airing the show.

This arrangement will lead to situations where advertising isn’t relevant to the listener due to such factors as the advertiser not in the listener’s location. The fact that an advertisement “baked in” to a podcast can be listened to ant any time can affect material that is time-sensitive due to campaign or jurisdiction issues.

What is being looked at now with various podcast infrastructures like Spotify, Apple or Google is the ability to provide dynamically-inserted content for podcasts. This will initially be investigated with news and current-affairs shows that have up-to-date content, including the idea of using local up-to-date newsbreaks. For advertising, this can also be about the introduction of localised spot advertising in to podcasts just like what a local radio broadcaster does to a syndicated show when they air it.

Listening to podcasts will be a similar experience to listening to syndicated radio shows

The problem I see with this kind of setup as far as how podcasters are paid is that it will follow the same rules as the syndicated content aired on commercial radio and TV. If the show has sponsorship with the “baked-in” advertising, the show’s producers and talent will be paid while the localised “spot” advertising simply pays the broadcaster. They may pay the show’s producers a “cut” of that advertising revenue as part of the syndication agreement.

But with this application, it will lead to an emphasis towards addressable advertising focused on narrow factors such as age, gender or detailed location like one’s neighbourhood. There will also be some influence based on the kind of podcasts or audiobooks you play through the podcast platform.

Here, it may require podcast formats to support the addition of standard metadata in order to identify logical breaks where advertising or other content can be inserted. Then the various podcast apps and platforms that run their own ad platforms will end up inserting the localised content in to the break. This may affect approaches like downloading for offline use, where it may be about downloading a collection of files that are joined by a podcast-specific playlist or creating a single concatenated audio file representing the main and supplementary content.

The above-mentioned logical breaks will also be of importance to the radio station who wants to syndicate that podcast. This may be to allow them to fulfil their obligations whether just to call the time and identify themselves on air, or to insert other content like news flashes, advertising / sponsorship and the like.

It will also apply to how you can listen to podcast content so you can, for example, recap parts of these shows that you were distracted from. This will be of importance for those of us who listen to podcasts in areas where we can be distracted easily like in the home or office in the same manner as listening to radio there.

There is also the idea of taking audio content further. For example, BBC and Amazon tried out the idea of an old-time radio play that works in a similar manner to a “Choose Your Own Adventure” book. This is with you talking to Alexa to steer yourself through the adventure very much in a similar form to interacting with those text-based computer adventure games on an old home computer.

Other ideas being looked at include driving or walking tours with rich audio commentary that plays when you are approach each point of interest.  This would be augmented through the use of GPS or similar navigation technology in order to play audio content relevant to the location. Similarly, you would be able to use the navigation software to lead you towards other waypoints that are part of the tour.

There are also the possibility of creating games that are augmented with the various pieces of audio content. This application would be driven by voice-driven assistants, perhaps in conjunction with sensors for various board and card games. It is a similar practice to some “Name That Tune” and similar board games which are based on a regular audio CD that has audio content essential to game play.

What is happening now is audio-focused content is gaining a stronger role in our lives and there are efforts to introduce flexibility in to how this content is presented. This is more so as we listen to this kind of content on many different device types.

If you use YouTube as a free user or surf around the Internet to most ad-facilitated blogs and Websites like this one, you will find that the display ads hosted are provided by an ad network owned or managed by Google. Similarly, some free ad-funded mobile apps may be showing ads that are facilitated through Google’s ad networks. Similarly, some advertisers pay to have links to their online resources placed at the top of the Google search-results list.

Over the past few years, there has been a strong conversation regarding the authenticity of political advertising on the online space thanks to the recent election-meddling and fake news scandals. This concern has been shown due to the fact that the online space easily transcends jurisdictional borders and isn’t as regulated as traditional broadcast, print and away-from-home advertising especially when it comes to political advertising.

Then there is also the fact that relatively-open publishing platforms can be used to present content of propaganda value as editorial-grade content. The discovery of this content can be facilitated through search engines and the Social Web whereupon the content can even be shared further.

Recently Facebook have taken action to require authentication of people and other entities behind ads hosted on their platforms and Pages or Public Profiles with high follower counts. This ins in conjunction to providing end-users access to archival information about ad campaigns ran on that platform. This is part of increased efforts by them and Google to gain control of political ads appearing on their platforms.

But Google have taken things further by requiring authentication and proof of legitimate residency in the USA for entities publishing political ads through Google-managed ad platforms that targeting American voters on a federal level. As well, they are keeping archival information about the political ads including the ads’ creatives, who sponsored the ad and how much is spent with Google on the campaign. They are even making available software “hooks” to this data for researchers, concerned citizens, political watchdog groups and the like to draw this data in to their IT systems for further research.

If you view a political ad in the USA on this site or other sites that use display advertising facilitated by Google, you will find out who is behind that ad if you click or tap on the blue arrow at the top right hand corner of that ad. Then you will see the disclosure details under the “Why This Ad” heading. Those of you who use YouTube can bring up this same information if you click or tap on the “i” (information) or three-dot icon while the ad is playing.

Google are intending to roll these requirements out for state-level and local-level campaigns within the USA as well as rolling out similar requirements with other countries and their sub-national jurisdictions. They also want to extend this vendor-based oversight towards issues-based political advertising which, in a lot of cases, makes up the bulk of that kind of advertising.

Personally I would also like to see Google and others who manage online ad platforms be able to “keep in the loop” with election-oversight authorities like the USA’s Federal Election Commission or the Australian Electoral Commission. Here, it can be used to identify inordinate political-donation and campaign-spending activity that political parties and others are engaging in.

Over the last five months, a strong conversation has risen surrounding electioneering and political advertising on the online platforms including social media and online advertising.

The trends concerning this activity is that the political advertising spend is moving away from traditional print and broadcast media towards online media as we make more use of highly-portable computing devices to consume our information and entertainment.

Issues that have also been raised include the use of fake comments and pre-programmed auto-responding “bots” as part of political campaigns. This is alongside the rise of very divisive political campaigns during the 2016 Brexit and US Presidential election cycles that played on racial and religious prejudices. There is also the fact that nation states with improper intentions are seeing the idea of poisoning the information flow as another weapon in their cyber-warfare arsenal.

It has also been facilitated through the use of highly-focused data-driven campaign-targeting techniques based on factors like race, gender, location and interests, with this practice being highlighted in the Cambridge Analytica saga that caught up Facebook and Twitter.

As well, the online advertising and social media platforms have made it easy to create and maintain an advertising or editorial campaign that transcends jurisdictional borders. This is compared to traditional media that would be dependent on having the advertising material pass muster with the media outlet’s advertising staff in the outlet’s market before it hits the presses or the airwaves.

This issue will become more real with the use of addressable TV advertising which is currently practised with some advertising-based video-on-demand services and some cable-TV platforms but will become the norm with traditional linear TV being delivered through through the increasing use of interactive-TV platforms.

This technology would facilitate “hyper-targeting” of political campaigns such as municipal-level or postcode/ZIP-code targeting yet maintain the same “air of legitimacy” that the traditional TV experience provides, making it feasible to destabilise elections and civil discourse on the local-government level.

Election-oversight authorities in the various jurisdictions like the Australian Electoral Commission or the UK’s Electoral Commission have been doing battle with the online trend because most of the legislation and regulation surrounding political and election activities has been “set in stone” before the rise of the Internet. For example, in most jurisdictions, you will see or hear a disclosure tag after a political advertisement stating which organisation or individual was behind that ad. Or there will be financial reporting and auditing requirements for the election campaigns that take place before the polls.

Facebook and Google are having to face these realities through the use of updated advertising-platform policies which govern political advertising, But Facebook applies this to candidate-based campaigns and issues-based campaigns while Google applies this to candidate-based campaigns only at the time of writing.

Firstly there is a prohibition on political advertising from entities foreign to the jurisdiction that the ad is targeted for. This is in line with legislation and regulation implemented by most jurisdictions proscribing foreign donations to political campaigns affecting that jurisdiction.

This is augmented through a requirement for political advertisers to furnish proof of identity and residence in the targeted jurisdiction. In the case of Facebook, they apply this policy to pages and profiles with very large followings as well as ads. Similarly, they implement a postcard-based proof-of-residence procedure where they send a postcard by snail mail to the user’s US-based home / business address to very presence in the USA.

Facebook augments this requirement by using artificial-intelligence to flag if an ad is political or not, so they can make sure that the advertiser is complying with the requirements for political advertising on this platform.

Like with traditional media, political ads on both these platforms will be required to have a disclosure tag. But Facebook goes further by making this a hyperlink that end-users can click on to see details like verification documents, why the viewer saw the ad along with a link to the sponsoring organisation’s Facebook Page. This has more utility than the slide shown at the end of a TV or online ad, the voice-announcement at the end of a radio ad or small text at the bottom of a print-media ad or billboard poster which most of these tags represent.

Both of the Internet titans will also make sure details about these campaigns are available and transparent to end-users so they know what is going on. For example, Facebook requires advertisers to maintain a Facebook Page before they buy advertising on any of the Facebook-owned platforms. This will have a “View Ads” tab which includes details about targeting of each current and prior campaign with a four-year archive allowance.

Google has taken things further by making sure that political organisations, politicians, the media and journalists are aware of the resources they have to assure data security for their campaigns and other efforts. Here, they have prepared a “Protect Your Election” Webpage that highlights the resources that they provide that are relevant for each kind of player in a political campaign. This includes Project Shield to protect Websites against distributed denial-of-service attacks, along with enhanced security measures available to operators of Google Accounts associated with critical data.

Both companies have been implementing these procedures for North America with Facebook trying them out in Canada then “cementing” them in to the USA before the midterm Congress election cycle there. Both companies then took action to suspend political ads from foreign entities outside Ireland during the election cycle for the Eighth Amendment abortion referendum taking place in that country. Here, they have applied the prohibition until the close of polls on May 25 2018. Let’s not forget that these standards will be gradually rolled out in to other jurisdictions over time.

But what I would like to see is for companies who run online advertising and social-media activity to liaise strongly with election-oversight officials in the various jurisdictions especially if it affects a currently-running poll or one that is to take place in the near future. This is in order to advise these officials of any irregularities that are taking place with political advertising on their online platforms or for the officials to notify them about issues or threats that can manifest through the advertising process.

A question that is being raised this year is the impact that the big technology companies in Silicon Valley, especially Google and Facebook, are having on the global media landscape. This is more so in relationship to established public, private and community media outlets along with the sustainability for these providers to create high-quality news and journalistic content especially in the public-affairs arena.

It is being brought about due to the fact that most of us are consuming our news and public-affairs content on our computers, tablets and smartphones aided and abetted through the likes of Google News or Facebook. This can extend to things like use of a Web portal or “news-flash” functionality on a voice-driven assistant.

This week, the Australian Competition and Consumer Commission have commenced an inquiry into Google and Facebook in regards to their impact on Australian news media. Here, it is assessing whether there is real sustainable competition in the media and advertising sectors.

There is also the kind of effect Silicon Valley is having on media as far as consumers (end-users), advertisers, media providers and content creators are concerned. It also should extend to how this affects civil society and public discourse.

It has been brought about in response to the Nick Xenophon Team placing the inquiry as a condition of their support for the passage of Malcolm Turnbull’s media reforms through the Australian Federal Parliament.

A US-based government-relations expert saw this inquiry as offering a global benchmark regarding how to deal with the power that Silicon Valley has over media and public opinion with a desire for greater transparency between traditional media and the big tech companies.

Toni Bush, executive vice president and global head of government affairs, News Corporation (one of the major traditional-media powerhouses of the world) offered this quote:

“From the EU to India and beyond, concerns are rising about the power and reach of the dominant tech platforms, and they are finally being scrutinised like never before,”

What are the big issues being raised in this inquiry?

One of these is the way Google and Facebook are offering news and information services effectively as information aggregators, This is either in the form of providing search services with Google ending up as a generic trademark for searching for information on the Internet; or social-media sharing in the case of Facebook. Alongside this is the provisioning of online advertising services and platforms for online media providers both large and small. This is infact driven by data which is being seen as the “new oil” of the economy.

A key issue often raised is how both these companies and, to some extent, other Silicon Valley powerhouses are changing the terms of engagement with content providers without prior warning. This is often in the form of a constantly-changing search algorithm or News Feed algorithm; or writing the logic behind various features like Google Accelerated Mobile Pages or Facebook Instant Articles to point the user experience to resources under their direct control rather than the resources under the control of the publisher or content provider. These issues relate to the end user having access to the publisher’s desktop or mobile user experience which conveys that publisher’s branding or provides engagement and monetisation opportunities for the publisher such as subscriptions, advertising or online shopfronts..

This leads to online advertising which is very much the direction of a significant part of most businesses’ advertising budgets. What is being realised is that Google has a strong hand in most of the online search, display and video advertising, whether through operating commonly-used ad networks like Adsense,  Adwords or the Google Display Network; or through providing ad management technology and algorithms to ad networks, advertisers and publishers.

In this case, there are issues relating to ad visibility, end-user experience, brand safety, and effective control over content.

This extends to what is needed to allow a media operator to sustainably continue to provide quality content. It is irrespective of whether they are large or small or operating as a public, private or community effort.

Personally I would like to see it extend to small-time operators such as what represents the blogosphere including podcasters and “YouTubers” being able to create content in a sustainable manner and able to “surface above the water”. This can also include whether traditional media could use material from these sources and attribute and renumerate their authors properly, such as a radio broadcaster syndicating a highly-relevant podcast or a newspaper or magazine engaging a blogger as a freelance columnist.

Other issues that need to be highlighted

I have covered on this site the kind of political influence that can be wielded through online media, advertising and similar services. It is more so where the use of these platforms in the political context is effectively unregulated territory and can happen across different jurisdictions.

One of these issues was use of online advertising platforms to run political advertising during elections or referendums. This can extend to campaign material being posted as editorial content on online resources at the behest of political parties and pressure groups.

Here, most jurisdictions want to maintain oversight of these activity under the context of overseeing political content that could adversely influence an election and the municipal government in Seattle, Washington want to regulate this issue regarding local elections. This can range from issues like attribution of comments and statements in advertising or editorial material through the amount of time the candidates have to reach the electorate to mandatory blackouts or “cooling-off” periods for political advertising before the jurisdiction actually goes to the polls.

Another issue is the politicisation of responses when politically-sensitive questions are being posed to a search engine or a voice-driven assistant of the Amazon Alexa, Apple Siri or Google Assistant kind. Here, the issue with these artificial-intelligence setups is that they could be set up to provide biased answers according to the political agenda that the company behind the search engine, voice-driven assistant or similar service is behind.

Similarly, the issue of online search and social-media services being used to propagate “fake news” or propaganda disguised as news is something that will have to be raised by governments. It has become a key talking point over the past two years in relationship with the British Brexit referendum, the 2016 US Presidential election and other recent general elections in Europe. Here, the question that could be raised is whether Google and Facebook are effectively being “judge, jury and executioner” through their measures  or whether traditional media is able to counter the effective influence of fake news.

Conclusion

What is happening this year is that the issue of how Silicon Valley and its Big Data efforts is able to skew the kind of news and information we get. It also includes whether the Silicon Valley companies need to be seen as another influential media company and what kind if regulation is needed in this scenario.

In most of the Western democracies, the election process is subjected to oversight by various local, regional or federal government election-oversight departments. These departments oversee the campaign activities that the political parties or candidates engage in during the election cycle; and this includes oversight of the kind of advertising that is being shown to the populace as part of a campaign.

As well, traditional radio and TV broadcasters, whether they are public or private, free-to-air or subscription-driven, are subject to oversight by federal or regional broadcast authorities. These authorities also work with the election-oversight authorities to oversee radio or TV election-campaign advertising in the context of the election process’s integrity.

All this oversight is to achieve a level playing field for the candidates and issues along with identifying and working against sources of undue influence upon the voters. This oversight also enforces various rules and practices regarding pre-poll campaign blackouts, mandatory sponsor identification for campaign messages and reporting of when and where the advertising appears.

But the online advertising platforms including the Social Web have, for a long time, escaped the stringent oversight of the various governments’ election-oversight and broadcasting-oversight authorities and this has recently raised questions in relationship to the integrity of a number of recent polls around the Western world such as the US Presidential Election.

Here, questions have been raised about the presence of troll ads sponsored by the Russian Government appearing on Facebook concurrent with the UK Brexit poll, the US Presidential Election and recent national elections that took place in France and Germany. Now the Seattle local government are raising issues with Facebook regarding advertising that was booked through that platform regarding their council elections. This was about Facebook violating a city bylaw that required advertising platforms like newspapers, radio or TV broadcasters to disclose who is buying political advertising targeted at that election.

One of the issues that are being raised include the ability with online advertising platforms for an individual or organisation no matter where they are located to target particular geographic areas down to the size of a suburb or town; or other particular user classes based on one or more particular attributes with a particular message.

It can become more disconcerting whenever firms in the TV and video industry implement directly-addressable advertising as part of their TV-advertising product mix, which allows for advertising campaigns to be directed at particular households or neighbourhoods like what happens with online advertising. This is because households seem to give a significant amount of trust to what is shown on the big screen in the living room when it comes to advertising.

Another is for the advertising to be presented as though it is part of legitimate editorial content in order to lower one’s “advertising-awareness” radar. This can be through comments that appear in a social-network’s main user feed or spam comments inserted in a comment trail or discussion forum. Similarly bloggers, podcasters and other influencers could also be paid to post political content supporting a particular candidate by a sponsoring entity.

This could breed situations where misinformation could be targeted at a “suburb of disadvantage” or an ethnically-focused community in order for them not to show up to vote or to vote against a candidate they are normally sure about and who represents their interests. This situation is considered of high risk in the USA where the election process supports voluntary attendance along with a significant number of citizens there not being “politically literate” and able to cast their votes astutely.

If Seattle tests this issue before the USA’s judiciary, other jurisdictions within and beyond the USA could watch these cases to observe how they can regulate online content and advertising in relation to the integrity of civic life.
